These terms govern the use of this website and the sale of watches by AV Meridiem.
1. About AV Meridiem
AV Meridiem is an independent dealer based in Brussels, Belgium, specialised in carefully selected pre-owned luxury watches. AV Meridiem is a Belgian registered business (No. BE 1037.637.308) and operates by appointment only.
2. Independent dealer disclaimer
AV Meridiem is an independent dealer and is not affiliated with Rolex, Patek Philippe, Audemars Piguet or any other watch manufacturer. Brand names and references are used for identification and illustration purposes only.
3. Nature of goods
All watches are pre-owned unless explicitly stated otherwise on the invoice. The detailed condition of each watch (case, crystal, bracelet, movement, known defects) is recorded on the invoice and accepted by the buyer upon signature.
4. Pricing & availability
Prices are displayed on the website and may change without notice. Availability is subject to prior sale. A watch is only reserved once confirmed in writing by AV Meridiem.
5. Payment
Payment is accepted by bank wire transfer only. A formal invoice is issued for every transaction. Watches are released or shipped once payment has been received in full and cleared.
6. Viewing, handover & shipping
Viewings are available by appointment in Brussels and the surrounding area. Whenever possible, watches are handed over in person. For clients outside the Brussels area, insured shipping is available at the buyer's expense and is fully insured for the declared value of the timepiece.
7. Legal warranty
In accordance with Art. 1649quater of the Belgian Civil Code, the legal warranty of conformity is limited to 12 months from the date of delivery for pre-owned goods. The buyer expressly acknowledges having been informed of this limitation prior to the conclusion of the sale, as required by Belgian law. Without this signed acknowledgement, a 24-month warranty would apply by default. The legal warranty does not cover defects known to the buyer at the time of purchase and explicitly listed on the invoice.
8. Commercial warranty
A 3-month commercial warranty is provided on internal mechanical defects of the movement only, unless stated otherwise on the invoice. This commercial warranty does not replace the legal warranty and cannot reduce it. It covers only defects arising under normal conditions of use.
9. Warranty exclusions
All warranties exclude: normal wear and tear (scratches, marks on case or bracelet), water resistance (no water resistance is guaranteed on pre-owned watches), damage caused by impact, dropping, misuse, moisture exposure, or third-party intervention. Known aesthetic defects listed on the invoice are also excluded.
10. Defect notification
The buyer must notify AV Meridiem of any defect as soon as possible and no later than 2 months after discovering it. Claims submitted after this deadline will not be accepted. Legal action must be brought within 1 year of the discovery of the defect.
11. Service procedure
Any warranty claim must be submitted in writing (email or post) with a description of the defect. No return or repair will be accepted without prior written approval from AV Meridiem. Return shipping costs are borne by the buyer, except where a defect is confirmed as covered by the legal warranty.
12. Liability
AV Meridiem's liability is strictly limited to the amount of the transaction. AV Meridiem shall not be liable for any indirect, consequential, or immaterial damages.
13. VAT — Margin scheme
Sales are made under the special margin scheme for second-hand goods (Art. 58 §4 of the Belgian VAT Code). VAT is not deductible by the buyer. Each invoice bears the mandatory notice: "Special scheme – Second-hand goods – VAT not deductible."
14. Governing law
These terms are governed by Belgian law. Any dispute falls under the exclusive jurisdiction of the Belgian courts.
